Rent Reviews

Commercial property leases usually provide for periodic rent reviews within the term of the lease.  We act on behalf of both landlord and tenant in negotiating a revised rent, however if agreement cannot be reached amicably then the dispute may be referred to either an Arbitrator or Independant Expert.  Our aim is to ensure the optimum result for our client and here we rely upon our wealth of experience.

Lease Renewals

A commercial lease will ultimately reach its contractual end whereupon there is a statutory process to follow for a lease to be renewed including security of tenure.  The renewal of a lease can be a very technical process and can lead to the matter being heard in court.  In addition to advising and negotiating the rent, lease term, user and break options etc. we would also consider where appropriate the incorporation of new terms and variation of existing terms to the clients benefit.  It is also an opportunity to consider alternative accomodation, down-sizing/up-sizing.



Lease Restructures
Restructuring a lease can bring opportunities and benefits to both landlords and tenants and providing the parties have a common interest they can agree to alter the terms of the existing lease.  For example a tenant could negotiate a lower rent or rent free period, whilst the landlord may negotiate the removal of a break clause or vary lease terms to give more security and additional value.  We have significant experience in advising on the restructure of leases to fulfill client's objectives whether landlord or tenant.

Expert Witness/Dispute Resolution

If a landlord and tenant are unable to agree on a revised rental at review, the lease will invariably provide for the rental dispute ro be referred to a third-party surveyor (Arbitrator or Independant Expert).  We have considerable knowledge and experience in acting as  an Expert Witness and in preparing valuation reports and replies for consideration by a third party surveyor.

Break Clause Issues

Many leases include a break option whitin the term which may favour either the landlord, the tenant or both for differing reasons.  The successful exercise of a break option usually depends on fulfilling certain conditions and invariably the party exercising such break has one opportunity per break to get it right.  Our experience in such matters will assist clients in extracting additional value from their lease interest.
